Our client was disabled as a result of a work accident. Our client lodged a total & permanent disability benefit claim against his superannuation fund. The superannuation fund and insurer deferred making a decision. Our client issued Court proceedings against the superannuation fund and insurer. Our client succeeded at trial and the case is reported at DAT THOAI NGUYEN v WESTSCHEME & LUMLEY LIFE [2005] WADC 87.
